Garnishment is a legal means for a creditor to receive payment for a debt directly from the debtor’s employer via a payroll deduction. With the exception of debts related to federal and state income tax liabilities and federally-backed student loans, wage garnishment requires a court order.
There are both federal and state garnishment laws. The Consumer Credit Protection Act (CCPA) provides the majority of federal garnishment law. State garnishment laws significantly vary, and when there is a discrepancy between federal and state law, the law that results in the lesser garnishment always applies.
Those who are involved in a wage garnishment, whether as the garnishee, the creditor filing for the garnishment, or the employer processing the garnishment, will likely need to utilize the relevant garnishment forms in the process. These forms vary by state, and most states provide at least some relevant forms on their court, law library, or legal aid website.
